Course Registration

Your participation in the Mountain Association for Community Development (“Mountain Association”) Strategic Initiatives Airbnb Training Program (the “Training Program”) is conditioned upon your compliance with and acceptance of these terms. Please review thoroughly before accepting.

Confidentiality. The Training Program contains Mountain Association’s proprietary and confidential information and may not be recorded, copied, published, distributed or transmitted, in whole or in part, by any medium or any form. Participant acknowledges and agrees that he or she will not record or permit the recording of any part of the Training Program which is to be conducted virtually via Zoom and YouTube. Participant further agrees and acknowledges that he or she will not distribute to any third party the YouTube link to the recorded session of the Training Program.

Ownership of Training Materials. Participant agrees and acknowledges that the workbook, documents, and all other materials provided during the Training Program (the “Training Materials”) are and shall remain the property of Mountain Association before, during, and after the Training Program. Participant further agrees and acknowledges that Mountain Association is the exclusive owner of any and all intellectual property associated with the Training Materials, including any and all patents, copyrights, trade secrets, trademarks, or confidential information. Participant will not reproduce, distribute, sell, or give the Training Materials to any third party.

Entire Agreement. This Agreement constitutes the sole and entire agreement of Participant and Mountain Association with respect to the subject matter of this Agreement, and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the subject matter.

Choice of Law. This Agreement and all matters arising out of or relating to this Agreement are governed by and construed in accordance with the laws of the Commonwealth of Kentucky without giving effect to the conflict. of laws provisions thereof to the extent such principles or rules would require or permit the application of the laws of any jurisdiction other than the Commonwealth of Kentucky.

Severability. If any provision of this Agreement is unenforceable under applicable law, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term and all other provisions of this Agreement will continue in full force and effect.

Equitable Remedies. Participant and Mountain Association agree that irreparable damage would occur if any provision of this Agreement were not performed in accordance with the terms hereof and that the parties shall be entitled to equitable relief, including injunctive relief or specific performance of the terms hereof, in addition to any other remedy to which they are entitled at law or in equity.
